The client rents equipment / s to the representative of New Horizon, José Buades Samper with DNI 78195713Z, subject to the terms and conditions of this contract:
1. Payment method:
a) Store reservations: in cash or card accepted upon delivery of the material and for the total duration of the rental contract.
b) Online reservations: through secure POS system, through credit / debit card. The amount paid will be 25%, the rest of the amount must be paid upon delivery of the material and for the total time of the rental contract.
a) At the time of delivery of the material, the client must necessarily present an identity document such as a passport, or National Identity Card in the case of European citizens.
a) The person who signs the rental contract must be over 18 years of age and will be responsible for the rented equipment.
4. Return policy:
a) Management fees are included in the final price of the reservation, these will not be returned. Therefore, in no case will 100% of the reservation be returned.
b) Cancellation 30 days before the start of the reservation: 90% refund.
c) Cancellation between 29 and 15 days before the start of the reservation: 50% refund.
d) Cancellation last 14 days before the start of the reservation: there are no refunds. A change of reservation is offered for another available date.
a) Customers who had to cancel their reservations during 2020 due to COVID-19, will be able to use their respective tickets for the amount they had paid, without being affected by possible rate changes during 2021.
b) Landlords that are affected by new measures by COVID-19 as of 2021 will be subject to the cancellation policy that affects Online Reservations point 4.
6. Equipment use:
a) The equipment must be used by the client designated in the rental contract.
b) The client is obliged to have the rented material controlled at all times.
c) The client is obliged to take care of the rented equipment as well as to take precautions to protect the equipment from damage, loss or theft.
d) In the event of any of the aforementioned situations, damage, loss or theft, the customer will immediately assume all the replacement costs incurred at market price.
e) The rented equipment will be for recreational sports use. Not for extreme sports uses, possible breakage of the material and physical injuries that this practice may cause will be the responsibility of the client.
f) Upon delivery of the material at the end of the rental agreement, a New Horizon representative will assess the condition of the material.
g) The client is obliged to secure the rented material at all times when it is not in sight, use the padlock to secure the elements of the bicycle such as the saddle, frame and wheels tied to a post fixed to the ground or bicycle parking. It is recommended to keep the material with you whenever possible.
h) The material must remain protected during the nights either in the hotel room itself, inside the rented house, in the hotel's own bicycle parking, but it must always remain locked at night, avoiding leaving the bicycles outside or garden of your hotel or apartment. In case of theft, point 6.d will apply.
7. Return of rented material:
a) The client will return the rented material together with all its accessories at the stipulated place, date and time. Any alteration must be previously authorized by the representative of New Horizon. Failure to comply with this condition entitles the representative of New Horizon to judicially require the return of the material.
8. Civil Liability:
a) It is the customer's responsibility to have their own insurance that covers any damage to themselves and damage to third parties, whether personal injury or material damage.
b) New Horizon has contracted its own civil liability insurance that covers the damages that its material by breakage could cause during the rental period to the client.
9. Responsibility of the New Horizon representative:
a) The New Horizon representative declares that he maintains a constant review of the bicycle components, repairing and changing all those that could cause problems during the rental, he is not responsible for breakages due to the misuse of the bicycle by the client ( frame breakage, fork, bent wheels, bumps, broken temple, broken gearbox, glass cuts, etc.) on tires and patches, all of them are the product of the misuse that the customer makes of the bicycle during the rental period. Of the same.
b) The representative of New Horizon declares to have taken the due precautions to avoid mechanical failures of the rented equipment, but in case of these, they do not assume any responsibility for the damages that directly or indirectly could cause the client, as a consequence of said failures or breakdowns.
10. Rental duration:
a) The duration of the rental may vary depending on whether the reservation is directly in the store or online.
b) If you rent in person at the store, the minimum period can be from 1 day depending on availability.
c) If you rent online, the minimum period is reflected in each bicycle, the minimum number of days may vary depending on the product you want to rent, it can be consulted in the technical sheet of each bicycle.
11. Traffic regulations:
a) It is the responsibility of the client and their companion (s) to know and respect the Spanish traffic regulations.
b) It is the responsibility and obligation of the client to wear the mandatory helmet.
c) It is important to have a good coexistence with other road users.
d) Do not throw garbage on the shoulders of the roads.
a) This contract is governed by Spanish law. The place of jurisdiction will be exclusively Illes Balears, Spain.
